LEGAL
Darraby on Art Law, a three-volume treatise, synthesizes the field of art law and provides a valuable resource for artists, talent, attorneys, museums, curators, galleries, dealers and collectors, corporate and institutional libraries, and all those working in the arts, creative industries, and intellectual property.
Volume 1: Art, Artifacts, Architecture & Museums provides cases that show how technology impacts copyright, publicity rights, trademark and trade dress in the arts, internet, music, sports, fashion, entertainment, publishing, sponsorship and celebrity branding. It also expands upon the origins and fundamentals of trade practices — valuation and appraisal; provenance, authenticity, and fraud; common law; the Uniform Commercial Code; auction and flourishing online sales; and many others.
Volume 2: Moral Rights, Copyright, Property Rights & Culture is a valuable resource on the Visual Artists Rights Act, moral rights, public art, murals, site specific art, and many others. It evaluates the history of American copyright and the history of moral rights laws from the time of Napoleon and earlier, originating in a largely Eurocentric Western tradition.
This volume defines the meaning of each term of copyright as it applies to VARA and moral rights in American law, where words of seemingly plain meaning are terms of art that have specific legal import. Volume 2 also includes new cases on sovereign immunity claims involving states and federal entities and separate sections on remedies, damages, and injunctive relief that apply to moral rights.
Volume 3 includes extensive reference materials that direct the reader to primary law, rules, and international regulations.
