Each year, we strive to improve the quality of our commentaries and rule annotations and to make this book more useful to practitioners. For this edition, we updated the commentaries with new case law throughout, and we made many other significant revisions and improvements, including incorporating the December 1, 2025, amendments to the Federal Rules of Civil Procedure (FRCPs) and Federal Rules of Appellate Procedure (FRAPs).

We revised our content on removal and remand to address recent Supreme Court authority on whether a federal court can retain supplemental jurisdiction over related state-law claims when the plaintiff amends its complaint after removal to delete all federal claims, leaving nothing but the state-law claims behind. We revised our content on whether the term “prevailing party” encompasses a party that is awarded a preliminary injunction if the case becomes moot before the court reaches a final judgment. See “Note,” ch. 9-C, § 4.2.1(1)(a)[1].
We added content to address recent Supreme Court authority on whether a voluntary dismissal without prejudice under FRCP 41(a) is a “final judgment, order, or proceeding” under FRCP 60(b). We added content to address recent Supreme Court authority on whether the extraordinary-circumstances standard applies when a party seeks to reopen a case under FRCP 60(b)(6) to file an amended complaint. See “Note,” ch. 10-F, § 3.6.6.
We revised our content to address recent Supreme Court authority on whether a litigant who prematurely files a notice of appeal before the district court grants a reopening the time for appeal must file a second notice of appeal after the appeal period is reopened. See “Note,” ch. 10-H, § 3.3.
