Description
Recognized as a core text on statutory construction by the American Bar Association and others, Sutherland Statutes, and Statutory Construction lays out the principles of statutory interpretation and helps you develop your own theories and positions supported by these principles, and by analysis of the legislative process itself.
Topics include legislative power, legislative organization and procedure, legislative form, legislative applicability, statutory interpretation, and application of the principles of statutory construction in selected areas of substantive law.
The treatise:
- Helps you articulate and support or challenge arguments for interpreting a statutory provision through analysis of its language and the legislative process
- Offers extensive federal and state caselaw support for all text propositions, including context-specific cases applying the rules of construction to selected areas of substantive law
- Includes reprints of edited versions of crucial articles by leading authorities on statutory interpretation and construction
- Contains a bibliography with secondary sources cited throughout the treatise
Every point discussed in Sutherland includes extensive citations from both federal and state jurisdictions, which provide strong support for the proposition and often also for contrary to positions.
With the August 2018 update, author Shambie Singer initiated the Eighth Edition, introducing its first three volumes. Volumes 3A-3C cover the application of the rules of statutory interpretation in selected areas of substantive law. Since 2018, the following volumes of the Eighth Edition have been issued: Volume 3 (2020), Volume 2 (2022), and Volume 1A (2025).
Completely rewritten, the Eighth Edition represents over a decade of sustained research and analysis. These new volumes build substantially on Sutherland's venerable, 130-year foundation and framework to reflect the most current doctrinal trends and results. For a more detailed discussion introducing the Eighth Edition, see the Introduction at the What's New or updated link.
Cited in over 120 federal and state courts during the past 12 months—including 13 federal circuit court decisions, and 48 decisions of state high courts—Sutherland continues to prove that it is the essential source for practitioners in understanding the legislative process and the principles for interpreting statutes.
